Susie Terms of Use

Here is a short summary of our Terms of Use.

We have included brief summaries at the beginning of each section to make it easier for you to read and understand this agreement. The summaries do not replace the text of each section, and you should still read each section in its entirety.

1. INTRODUCTION

By accessing or using Susie’s Services, you agree to be bound by this Terms of Use Agreement (the “Terms” or “Agreement”), including our Privacy Policy, Cookie Policy, Community Guidelines, and Safety Tips, so it is important that you read this Agreement and these policies and procedures carefully before you create an account.

PLEASE CAREFULLY REVIEW THE DISPUTE RESOLUTION PROVISIONS IN SECTION 14 BELOW. THESE GOVERN THE MANNER IN WHICH DISPUTES WILL BE ADDRESSED BETWEEN YOU AND SUSIE.

We may update these Terms from time to time, so check this page regularly for updates.

Welcome to Susie – the AI-powered dating app that helps you see the story before it starts.

1.1 Your Agreement with Susie

By accessing or using our Services, you agree to be bound by this Agreement.

• If you live in the European Economic Area (EEA), the United Kingdom (UK), or Switzerland, these Terms are with Susie Dating App LLC. For the purposes of the General Data Protection Regulation (GDPR), Susie Dating App LLC is the controller of your personal data, and we have appointed an EU Representative whom you may contact if you are in the EEA/UK. Contact details for our representative are available in our Privacy Policy.
• If you live anywhere else, these Terms of Use are between you and Susie Dating App LLC (“Susie”), 123 Main Street, Suite 456, Tampa, Florida 33602, USA.

The terms “us”, “we”, “Company” and/or “Susie” refer to Susie Dating App LLC. Together you and Susie may be referred to as the “Parties” or separately as “Party”.

By accessing or using our Services on www.datesusie.com (the “Website”), the Susie mobile application (the “App”), or any other platforms or services Susie may offer (collectively, the “Service” or our “Services”), you agree to, and are bound by this Agreement. This Agreement applies to anyone who accesses or uses our Services, regardless of registration or subscription status.

Your access and use of our Services is also subject to the Privacy Policy, Cookie Policy, Community Guidelines, and Safety Tips, and any terms disclosed and agreed to by you when you purchase additional features, products, or services from Susie (“Additional Terms Upon Purchase”), which are incorporated into this Agreement by reference. If you do not wish to be bound by this Agreement, do not access or use our Services.

2. ACCOUNT ELIGIBILITY; YOUR RESPONSIBILITIES

Before you create an account on Susie, make sure you are eligible to use our Services. This Section also details what you can and can’t do when using the Services, as well as the rights you grant Susie.

You are not authorized to create an account or use the Services unless all of the following are true, and by using our Services, you represent and warrant that:

1. You are an individual (i.e., not any body corporate, partnership or other business entity) at least 18 years old;
2. You are legally qualified to enter a binding contract with Susie;
3. You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country;
4. You are not on any list of individuals prohibited from conducting business with the United States;
5. You are not prohibited by law from using our Services;
6. You have not committed, been convicted of, or pled no contest to a felony or indictable offense (or crime of similar severity), a sex crime, or any crime involving violence or a threat of violence, unless you have received clemency for a non-violent crime and, upon our review of official documentation you provide, we determine in our reasonable discretion, based on our internal safety criteria, that you do not pose a threat to our community;
7. You are not required to register as a sex offender with any state, federal or local sex offender registry;
8. You do not have more than one account on our Services; and
9. You have not previously been removed from our Services or our affiliates’ services by us or our affiliates, unless you have our express written permission to create a new account.

3. AI-GENERATED CONTENT AND PREDICTIONS

This section specifically addresses our AI-powered features, including offspring predictions and personality compatibility forecasts.

3.1 AI Offspring Predictions

Susie utilizes advanced artificial intelligence to generate hypothetical visual projections of potential future offspring based on a visual analysis of facial features from user-provided photographs. This feature is for entertainment purposes only and does not analyze your DNA or actual genetic material. You acknowledge and agree that:

3.2 MBTI and Personality Compatibility

Our personality compatibility features utilize Myers-Briggs Type Indicator (MBTI) and other psychological frameworks to suggest potential matches. You acknowledge that:

• Personality assessments are tools for self-discovery and relationship exploration. Frameworks like the MBTI are not scientifically validated clinical tools and should not be used to diagnose or make definitive judgments about yourself or others.
• Compatibility scores are suggestions based on psychological theories, not guarantees of a successful relationship.
• Individual relationships are complex and influenced by many factors beyond personality type.
• We do not guarantee successful relationships based on compatibility scores.

3.3 AI Technology Limitations

You understand that:

• AI technology is constantly evolving and may contain errors or limitations.
• Predictions are based on available data and current scientific understanding.
• We do not claim that our AI features are scientifically validated or clinically proven.
• Results may vary significantly between users and over time.

3.4 Ethical Use of AI Features

You agree to use Susie’s AI features responsibly and ethically. You are expressly prohibited from:

1. Using the AI Offspring Prediction feature to systematically screen, filter, or reject other users based on perceived racial, ethnic, or phenotypic traits of the AI-generated image.
2. Using any AI-generated content (including offspring predictions or personality analyses) to harass, bully, mock, demean, or cause emotional distress to another person.
3. Presenting AI-generated content to others as scientifically accurate or as a factual basis for making significant life decisions (e.g., relationship choices, family planning).

A violation of this Section 3.4 constitutes a material breach of this Agreement and may result in the immediate and permanent termination of your account.

4. YOUR CONTENT

You retain ownership of content you submit to Susie, but you grant us a license to use it.

4.1 License to Your Content

By submitting content to our Services, you grant Susie a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, transmit, create derivative works from, distribute, and display such content for the limited purpose of operating, developing, providing, and improving the Service and researching and developing new ones. For the avoidance of doubt, this license does not grant Susie the right to use your content or any AI-generated content derived from it (such as offspring predictions) in our external advertising or marketing materials without your separate, explicit consent.

4.2 Content Guidelines

You agree not to submit content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Infringes on intellectual property rights
• Contains false or misleading information
• Promotes violence, discrimination, or illegal activities
• Contains sexually explicit material or nudity
• Impersonates another person or entity

5. PRIVACY AND DATA PROTECTION

We are committed to protecting your privacy and handling your data responsibly.

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

5.1 AI Data Processing

By using our AI features, you consent to:

• Processing of your photos and personal information for AI analysis
• Storage of your data for the purpose of improving our AI algorithms
• Sharing of anonymized data for research and development purposes
• International transfer of your data as necessary for service provision

5.2 Data Retention

We retain your data for as long as necessary to provide our Services and comply with legal obligations, as detailed in our Privacy Policy. Upon account deletion, your personal profile will no longer be visible on the Services. While we may retain anonymized or aggregated data sets that include data derived from your content for the sole purpose of improving our AI algorithms, we will take commercially reasonable steps to ensure this data is disassociated from your personal account and cannot reasonably be used to re-identify you.

6. SUBSCRIPTION AND PAYMENT TERMS

This section explains our subscription plans and payment terms.

6.1 Subscription Plans

Susie offers various subscription plans with different features and pricing. All subscriptions automatically renew unless cancelled.

6.2 Payment Processing

Payments are processed through third-party payment processors. You agree to pay all fees associated with your subscription.

6.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting customer support. Refunds are subject to our refund policy and applicable law.

7. PROHIBITED CONDUCT

You agree not to engage in certain activities when using our Services.

You agree not to:

• Use our Services for any illegal purpose
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of our Services
• Use automated systems to access our Services
• Create fake profiles or impersonate others
• Share inappropriate or offensive content

8. INTELLECTUAL PROPERTY

Susie owns the intellectual property rights to our Services and content.

8.1 Our Rights

All content, features, and functionality of our Services are owned by Susie and are protected by copyright, trademark, and other intellectual property laws.

8.2 AI-Generated Content

AI-generated offspring predictions and other AI content are created using our proprietary technology. Susie and its licensors retain all intellectual property rights in the AI technology and algorithms. Susie grants you a limited, non-exclusive, non-transferable, revocable license to use the AI-generated content you create for your own personal, non-commercial purposes (e.g., sharing with friends or on your personal social media profiles). You may not:

• Reproduce, distribute, or commercialize AI-generated content for any business purpose.
• Claim ownership of our AI technology or algorithms.
• Use AI-generated content in a way that violates our Community Guidelines or the Ethical Use policy in Section 3.4.

9. DISCLAIMER OF WARRANTIES

We provide our Services “as is” without warranties.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUSIE PROVIDES OUR SERVICES “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SPECIFICALLY REGARDING AI FEATURES:

• We do not warrant that AI predictions will be accurate or reliable
• We do not guarantee that offspring predictions will resemble actual children
• We do not warrant that personality compatibility assessments will lead to successful relationships
• AI features are provided for entertainment and educational purposes only

10. LIMITATION OF LIABILITY

Our liability is limited as described in this section.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUSIE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OUR SERVICES.

SPECIFIC LIMITATIONS FOR AI FEATURES:

• We are not liable for emotional distress related to AI prediction accuracy
• We are not liable for relationship decisions based on our compatibility assessments
• We are not liable for any damages arising from reliance on AI-generated content
• Our total liability for any claims related to AI features shall not exceed the amount you paid, if any, for our Services in the 12 months preceding the claim. If you have not paid Susie any amounts in the prior twelve (12) months, Susie’s sole and exclusive liability for any dispute shall not exceed fifty U.S. dollars ($50.00).

11. INDEMNIFICATION

You agree to indemnify Susie for certain claims.

You agree to indemnify, defend, and hold harmless Susie and its affiliates from and against any claims, damages, losses, and expenses arising from your use of our Services or violation of these Terms.

12. TERMINATION

We may terminate your account for violations of these Terms.

We may terminate or suspend your account at any time without notice if we believe you have violated these Terms, or for any reason that we believe, in our reasonable discretion, jeopardizes the safety of our community or the integrity of our Services.

13. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, USA.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law principles.

14. DISPUTE RESOLUTION

Disputes will be resolved through arbitration or small claims court.

Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration, except for claims that may be brought in small claims court.

15. CHANGES TO TERMS

We may update these Terms from time to time.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website.

17. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Susie.

These Terms, together with our Privacy Policy, Cookie Policy, and Community Guidelines, constitute the entire agreement between you and Susie regarding your use of our Services.
